TERMS AND CONDITIONS OF USE OF THE PLATFORM

This document sets forth the Terms and Conditions (the “Terms and Conditions”) governing access to and use of the e-commerce website www.byera.com operated by FAM CARE LABS S.A.C..
Any person who maintains a commercial relationship with BY.ERA and wishes to access or use the Platform may do so subject to these Terms and Conditions, as well as the other policies and principles governing BY.ERA, which are incorporated herein by reference. Consequently, all visits, registrations, and transactions carried out on the Platform, as well as their legal effects, shall be governed by these rules and subject to applicable Peruvian law.
DEFINITIONS
Platform: Website and/or mobile application operated by BY.ERA for the commercialization of its own cosmetic products.
User: Any person who accesses, browses, or uses the Platform, whether registered or as a “Guest User”.
Guest User: A User who completes a purchase without creating a registered account.
Account: Optional registration created by a User to access additional features.
Product(s): Cosmetic goods offered by BY.ERA through the Platform.
Content: Information, images, texts, graphics, photographs, videos, and other elements available on the Platform.
Services: Browsing, purchasing, payment, delivery, and post-sale support functionalities offered through the Platform.
ACCEPTANCE OF THE TERMS AND CONDITIONS
By creating a User Account and/or using the Platform, you agree to these Terms and Conditions, as well as all other rules, policies, and operating procedures published on the Platform, by completing your information and clicking “Accept”, thereby expressing your consent through this electronic means.
These Terms and Conditions apply to all users of the Platform and form an integral part of all acts and contracts executed or entered into within the framework of commercial relationships between users of this site and BY.ERA through the Platform, including the Privacy Policy and Cookie Policy of BY.ERA.
All Users must review and understand these Terms and Conditions and all information incorporated by reference before using the Platform and/or purchasing BY.ERA Products.
If the User does not accept these Terms and Conditions, BY.ERA will not be able to provide its products and services, including access to and use of the Platform, and therefore purchases cannot be processed.
MODIFICATIONS TO THE TERMS
BY.ERA may modify these Terms and Conditions at any time by publishing an updated version on the Platform.
Modifications shall take effect five (5) business days after publication. When significant changes are made to our services, such changes will be published at least ten (10) calendar days in advance so Users may review them and continue using the Platform. In no case shall such changes affect transactions already completed.
The User shall provide consent to and accept the new Terms and Conditions in the same manner as the previous version, as described in Section I. If the User does not accept the updated Terms and Conditions, the services may no longer be provided, as stated in Section I.
LEGAL CAPACITY AND USE OF THE PLATFORM
The Platform is intended for persons with legal capacity to contract, whether directly or through sufficient delegated authority. Persons lacking such capacity may not use the Services.
Purchases may be made by creating a User Account or as a Guest User, providing only the information necessary to complete the purchase.
The User declares that all information provided to make a purchase is true, complete, and current and assumes full responsibility for its accuracy.
USER ACCOUNT (OPTIONAL REGISTRATION)
Creating a User Account is optional.
Registered Users are responsible for the information associated with their Account and for keeping it updated, as it will be used by BY.ERA to process purchase requests.
Upon registration, the User will receive a password (the “Password”) which, together with their email address (the “Account”), allows access to the registered Account. The Password is for personal use only, and any use thereof shall be the sole responsibility of the User.
BY.ERA may suspend or close an Account if fraudulent use, false information, or actions affecting the integrity or security of the Platform are detected.
BY.ERA may reject a registration request or cancel an existing Account without entitling the User to compensation. Users whose Accounts have been disabled may not register again.
PURCHASE FORMALIZATION
A purchase is considered completed when the User:

Selects the Products.

Enters the required delivery and contact information.

Selects a payment method.

Receives a purchase confirmation email from BY.ERA.
Confirmation is subject to verification of:

Product availability,
-
Payment validation,
-
Payment method confirmation.
BY.ERA may cancel a purchase if payment is not validated or if the Product is out of stock. In such cases, the User will be notified and a refund will be issued accordingly.
PRICES, OFFERS, AND PROMOTIONS
Prices are expressed in Dolar ($) and include taxes unless otherwise stated. Users may change the currency displayed in the upper right corner of the screen.
Transactions will be processed in the selected currency. The exchange rate applied is determined by the payment gateway and the User’s bank.
Offers and promotions apply only to the specified Products and while stock lasts.
Applicable discounts will be visible on the product page and reflected at checkout. Otherwise, the discount does not apply or the Product is out of stock. BY.ERA reserves the right to correct typographical errors or obvious omissions. Promotions may be subject to specific conditions that will be disclosed in advance.
PAYMENT METHODS
Payments may be made through the payment methods enabled by BY.ERA’s payment gateway, PayPal, operated by PayPal Inc. as displayed during checkout.
All transactions may be subject to:

Approval by the issuing bank,

Anti-fraud validations by the payment gateway,

Verification of User-provided data.
Transactions may be canceled or suspended if fraud or unauthorized use is detected. Users may contact BY.ERA via customer service or their bank.
PRODUCT DELIVERY
BY.ERA works with the following local and international shipping partners: Deutsche Post AG and/or DHL SUPPLY CHAIN DE LIMA S.A.C., Tax ID (RUC) No. 20606158751 (“DHL”). [LIST CARRIERS]
Products will be delivered to eligible shipping zones. If a delivery address is not eligible, this will be indicated at checkout. The User is responsible for providing an accurate and complete delivery address. Delivery times are calculated from purchase confirmation.
Indicatively, delivery times range between five (5) and twenty (20) business days, depending on the destination and shipping method selected. The exact estimated delivery time and tracking information will be provided at checkout. If the address is incorrect or the User is unavailable, the order may be returned and canceled.
Address changes may only be requested before receiving the purchase confirmation email.
Delivery may be made to a third party designated by the User. In such cases, the User assumes full responsibility for any loss. Delivery acceptance is confirmed upon signing the delivery receipt. If visible damage exists, the User must not accept the Product and must note it on the delivery document.
Shipping costs, including customs clearance for international shipments, are borne by the User.
TAX RECEIPTS
The User must select the correct receipt type (sales receipt or invoice) at checkout. Electronic receipts will be issued in accordance with applicable regulations.
EXCHANGES, RETURNS, AND WARRANTIES
For hygiene and health reasons, opened or used Products or Products without safety seals cannot be returned, except in cases of manufacturing defects.
Claims may be submitted for:

Transport damage visible upon delivery or missing items.

Product defects not attributable to misuse.
Requests must be submitted to contact@byera.com with order details and photographic evidence.
Request deadlines:

Visible damage or missing items: within 48 hours of delivery.

Sealed, unopened cosmetic products: within 14 days of delivery.
Shipping costs for returns are borne by the User unless a manufacturing defect is confirmed.
INTELLECTUAL PROPERTY
All Platform content, design, trademarks, photographs, and other elements are the exclusive property of BY.ERA or licensed for use.
Unauthorized reproduction or use is prohibited.
PROHIBITED USES
Users are prohibited from:

Engaging in illegal or fraudulent activities,

Manipulating prices or promotions,
-
Providing false information,
-
Interfering with Platform security or functionality.
PERSONAL DATA PROTECTION
Personal data processing is governed by BY.ERA’s Privacy Policy, in accordance with Law No. 29733 and Supreme Decree No. 016-2024-JUS.
LIMITATION OF LIABILITY
BY.ERA is not liable for:

Platform interruptions beyond its control,

User-provided data errors,
-
Improper Product use,
-
Force majeure events.
Nothing herein limits non-waivable consumer rights under Law No. 29571.
SUSPENSION AND TERMINATION
BY.ERA may suspend or terminate access in cases of fraud, false information, or misuse of the Platform.
